1.1. These terms and conditions of use (“Terms of Use”) explain how you may use this website and any of its content (“Website”). These Terms of Use apply between dussl Limited (“dussl”, “we”, “us” or “our”) and you, the person accessing or using the Website (“you” or “your”).

3.1. The Website is for your use only and you agree that you are solely responsible for all costs and expenses you may incur in relation to your use of the Website.

8.1. While we try to make sure that the Website is secure, we do not actively monitor or check whether information supplied to us through the Website is confidential, commercially sensitive or valuable.

11.2. You retain ownership of all intellectual property rights in your User Content. However, by submitting User Content, you grant us and our affiliates a worldwide, irrevocable, perpetual, royalty-free, non-exclusive license to use, reproduce, store, adapt, publish, distribute, publicly display, perform, and create derivative works of your User Content for purposes including, but not limited to:
11.2.1. marketing and promotion on our website, social media platforms, and email campaigns;
11.2.2. printed materials and packaging;
11.2.3. advertising campaigns and branded content; and
11.2.4. editorial, trade, and commercial purposes.
11.3. You also grant us the right to sublicense these rights to trusted third parties, including marketing agencies, media buyers, branding consultants, and retail stockists, to support our promotional efforts.
11.4. By tagging our social media handle (@dussl.co) or using any of our hashtags (e.g., #dussl), you consent to our use of such User Content in line with this clause.

11.5.1. you are the sole creator and owner of the User Content or have all necessary rights and permissions to submit it;
11.5.2. you have obtained explicit consent from any individuals featured in the User Content, or if such individuals are under 18, consent from their parent or legal guardian;
11.5.3. the User Content does not infringe any copyright, trade mark, or other intellectual property rights of any third party;
11.5.4. the User Content complies with all applicable laws and regulations;
11.5.5. the User Content is not unlawful, defamatory, obscene, abusive, offensive, or otherwise objectionable;
11.5.6. the User Content does not contain any malware, viruses, or other harmful components; and
11.5.7. the User Content is accurate and not misleading.

11.7.7. misrepresent your identity or impersonate another person.
11.8. We reserve the right, but are not obligated, to monitor, edit, or remove User Content that we determine:
11.8.1. violatestheseTerms;or
11.8.2. is unlawful, offensive, or otherwise objectionable; or infringes the rights of any third party.
11.9. Any User Content you submit may be displayed for as long as we consider appropriate and may remain accessible even after you have deactivated your account or deleted the original content.
11.10. You acknowledge and agree that User Content is non-confidential and non-proprietary.
11.11. If you share content on social media using @dussl.co or our hashtags (e.g., #dussl), we may repost, share, or otherwise use your User Content across our marketing channels, including online and offline media.
11.12. By tagging or hashtagging, you affirm and warrant that the User Content complies with the warranties and standards outlined in this clause.
11.13. We are not obligated to maintain any User Content in confidence.
11.14. We are under no obligation to pay compensation for User Content or respond to submissions.
11.15. You agree to indemnify and hold us harmless from any claims, damages, or expenses (including legal fees) arising from:
11.15.1.your breach of these Terms; or
11.15.2.any claim by a third party related to your User Content, including allegations of intellectual property infringement, defamation, or privacy violations.
11.16. We are not responsible for User Content submitted by you or others, including any errors, omissions, or inaccuracies.
11.17. We are not liable for any loss or damage arising from User Content, including unauthorised access to or misuse of such content by third parties.
12. Our responsibility to you
12.1. If we breach these Terms of Use or are negligent, we are liable to you for foreseeable loss or damage that you suffer as a result. By ‘foreseeable’ we mean that, at the time these Terms of Use were formed, it was either clear that such loss or damage would occur or you and we both knew that it might reasonably occur, as a result of something we did (or failed to do).
12.2. We are not liable to you for any loss or damage that was not foreseeable, any loss or damage not caused by our breach or negligence, or any business loss or damage.
12.3. Nothing in these Terms of Use excludes or limits our liability for any death or personal injury caused by our negligence, liability for fraud or fraudulent misrepresentation, or any other liability that the law does not allow us to exclude or limit.

We are not liable to you if we fail to comply with these Terms of Use because of circumstances beyond our reasonable control.

17. Governing Law and Jurisdiction
17.1. The laws of Scotland apply to these Terms of Use, although if you are resident elsewhere you will retain the benefit of any mandatory protections given to you by the laws of that country.
17.2. Any disputes will be subject to the non-exclusive jurisdiction of the courts of Scotland. This means that you can choose whether to bring a claim in the courts of Scotland or in the courts of another part of the UK in which you live.
